Letter from Mr Ponder to Dr French

Letter from Mr Nathaniel Ponder to Dr French.
At the request of Mr Calvert, relative to the college estates in London, he has to inform him that Mr Sparrow, the college under-tenant of he No.6 and No.7 Ludgate Hill now on lease to Mr C G Cooke has its the consent of his landlord, the said C G Cooke positively refused to pay the last years rent of £6 2s due to Jesus College last Michaelmas, even though he has applied for it several times in the usual manner.
The alleged cause is that an application has been by the city solicitor for £12 10s arising out of a quit rent of 8s per annum. For the last 30 years this is now demanded of Mr Sparrow. Repeated applications have been made to the college on its authorised agents in London, but without effect.
Mr Ponder is not aware that he has been either written to or called upon in respect of this demand, nor has Mr Winter.
Mr Sparrow's solicitor is of the opinion that the college is liable but Mr Winter is of a contrary opinion.
He therefore wants to know how to act, and asks that Dr French elevate the matter by reference of some of your old papers and as to whether you have ever paid or allowed this claim.
He is of the opinion that he very much doubts the liability lies with the tenant. He has attached copies of 2 receipts for similar rates, changeable on the same premises and paid by Mr Blades who occupies a part of these premises situated in Stone Cutter Street. He believes that Mr Blades holds under Mr Cooke and he thinks it probably that some new arrangements respecting this rate might have taken effect at the time in lieu of that now claimed and that principle in which this was adopted may have been forgotten.

Letter from Benjamin Wyatt to Mr Hustler. From London 31st July 1821.
He says he is sorry to hear that Mr Hustler is so unwell. He apologises as it was not his intention to make any charge to the college on his own account, but as he has been told it will be more convenient for the college if he does make a charge, he will do so in compliance with that desire.
He notes that he has already sent the bill which shall be paid to Mr West, and in addition to that sum, he would say ten guineas for himself, understanding from his letter that it is the wish of the college that I should make a charge on my own account. If you pay the money into this account for Mr West and Mr Bernasconi, he will immediately furnish them with their respective acknowledgements for the same.

He says that having not examined his bankers book for some days past, he was aware until today that any money had been paid in on his account on behalf of Jesus College. However, he now encloses these acknowledgements, from himself, Mr. West and Mr. Bernasconi, respectively, and shall be glad to hear that they reach him safely.

Letter from Benjamin Wyatt to Mr Hustler. From London 23rd July 1821.
The letter addresses the Bernasconi case. He explains that even though he thinks that they have concluded that Wyatt will probably never give his conclusions on the Bernasconi case, it has always been his intention and wish to discharge the trust which has been placed in him. He says he should have done all that was required of him long ago, and he apologises.
He reports that in the former report to him, he concluded that an abatement of £119 2s 1¾d ought to be made to W Bernasconi, but in his late investigation of the account, he has had the fullest and most complete evidence which he could do to enable him to correct all errors in his calculations, and to arrive at a conclusive and infallible decision. The result is that instead of an abatement of £119 2s 1¾d, it is £138 11s 4¼d.
He feels it is incumbent upon him to state most clearly that Bernasconi is not to blame in this situation; the overcharge has arisen from his error. It was from not having sufficiently distinguished between the time in a day worked and that upon measured worked, so that a great part of the time was brought into account twice over, without Bernasconi (or probably anyone) being aware of it.
Wyatt says he has explained to Bernasconi the result of his investigation, and he is perfectly satisfied that it is just.
He pleads for him not to attack Bernasconi, for he is convinced that he was ignorant of the real circumstances of the accounts. The reduction above makes the gross amount of his bill £264 8s 3½d, of which he has already received an amount of £240, meaning he is owed £24 8s 3½d.
He also has enclosed a small bill which he shall have to pay for the time bestowed on the calculations connected with the examination of this account, because although he is happy to give any of his own labour to the college, he is persuaded that he should pay out of his own pocket for the purpose.
